These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and Varahii India ("Company", "we", "us", "our"), the owner and operator of Doczone.in at https://doczone.in/ ("Website"). These Terms are published in accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and other applicable Indian laws. By accessing or using the Website in any manner, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Disclaimer, and Data Resource Declaration, each of which is incorporated herein by reference. If you do not agree, do not use the Website.

1. Eligibility

The Website is intended for use by persons who are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. If you are accessing the Website on behalf of a minor, an entity, a clinic, or a hospital, you represent that you are authorised to bind such person or entity to these Terms.

2. Description of Service

DocZone is a free online directory that aggregates publicly available and user/practitioner submitted information about doctors, medical practitioners, hospitals, clinics, diagnostic centres, and other healthcare and non-healthcare related businesses in India, and allows Users to browse, search, submit inquiries, or request to claim/complete a Listing. The Website does not sell, broker, refer, or facilitate any medical service, product, drug, or device, and no payment is processed through the Website for any medical service.

3. Account Registration and Listing Submissions

Where the Website allows a practitioner or facility to register, claim, or submit/update a Listing, the submitting party warrants that: (a) all information provided is true, accurate, current, and complete; (b) they hold all licences, registrations, and qualifications claimed; (c) they have obtained all consents necessary (including from patients, staff, or third parties) for any content, image, or data submitted; and (d) the submission does not infringe any third party's intellectual property, privacy, or other rights. Varahii India reserves the right to reject, edit, suspend, or remove any Listing or account at its sole and absolute discretion, without notice or liability.

4. Free Service; No Guarantee of Continuity

Listings and browsing are provided free of charge. Varahii India reserves the right to introduce paid features, promoted/sponsored listings, or subscription plans at any time, and to modify, suspend, restrict, or discontinue the Website or any part or feature thereof, temporarily or permanently, with or without notice, without any liability to Users or listed practitioners.

5. Acceptable Use

You agree that you shall not, and shall not attempt to:

• scrape, crawl, harvest, mine, or extract data from the Website using automated means without prior written consent;
• reverse engineer, decompile, or interfere with the Website's software, security, or infrastructure;
• upload false, defamatory, obscene, misleading, or unlawful content, including fake reviews or impersonation of any practitioner or facility;
• use the Website for any unlawful, fraudulent, or unauthorised commercial purpose, including unsolicited marketing or spam directed at listed practitioners or Users;
• upload viruses, malware, or any code intended to disrupt the Website;
• violate the intellectual property, privacy, or other legal rights of Varahii India or any third party; or
• use the Website in any manner that could disable, overburden, damage, or impair it.

6. Intellectual Property

All content, design, layout, graphics, compilations, look-and-feel, trademarks (including "DocZone" and its logo), and software on the Website are the exclusive property of Varahii India or its licensors and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws. No right, title, or licence is granted to Users except a limited, revocable, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes. Any compiled directory data, database structure, and aggregation methodology constitute Varahii India's proprietary database rights.

7. Third-Party Interactions

Any interaction, communication, appointment, consultation, payment, or transaction between a User and a listed practitioner or facility is strictly between such parties. Varahii India is not a party to, and bears no responsibility, liability, or obligation in connection with, any such interaction, including any dispute regarding quality of service, professional negligence, billing, or conduct.

8. Disclaimer of Warranties

The Website and Content are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by applicable law. Please refer to our Disclaimer and Data Resource Declaration, which are incorporated into these Terms in full.

9. Limitation of Liability

To the fullest extent permitted under Indian law, Varahii India's total aggregate liability arising out of or relating to these Terms or use of the Website shall not exceed ₹500 (Rupees Five Hundred only), and Varahii India shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of health, life, data, revenue, or goodwill, howsoever arising.

10. Indemnification

You agree to indemnify and hold harmless Varahii India, its directors, employees, and agents from any claim, liability, damage, loss, or expense (including legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any law or third-party right.

11. Termination

Varahii India may suspend or terminate your access to the Website at any time, with or without cause or notice, including for suspected violation of these Terms, without liability. Clauses that by their nature should survive termination (including Sections 6, 8, 9, 10, 12, and 13) shall survive.

13. Governing Law, Jurisdiction, and Dispute Resolution

These Terms are governed by the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Website shall be subject to the exclusive jurisdiction of the courts at Mira Road, Thane District, Maharashtra, India only, and Users irrevocably waive any objection to venue or forum in any other court or tribunal in India or elsewhere.

14. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.

15. Entire Agreement and Amendments

These Terms, together with the Privacy Policy, Cookie Policy, Disclaimer, WhatsApp Usage Consent, Do Not Sell My Data policy, and Data Resource Declaration, constitute the entire agreement between you and Varahii India regarding the Website. Varahii India may revise these Terms at any time by posting updated Terms on the Website; continued use after such posting constitutes acceptance.
